US Judge Orders Freedom of Abrego Garcia from Immigration Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
