India Orders Smartphone Makers to Preload Handsets with State-Owned Cyber Safety App

In a notable step, India's telecoms department has confidentially directed smartphone manufacturers to preload all new phones with a state-owned cybersecurity application that must remain installed. This order, which has come to light, is expected to alarm major technology firms like Apple and prompt questions among digital rights groups.

A Worldwide Shift in Digital Security Policy

Addressing a recent surge of online fraud and device misuse, India is aligning with governments worldwide. This action echoes similar measures enacted in countries like Russia, which aim to curb the use of stolen phones for fraud and push official service apps.

What Manufacturers Are Bound by the Directive?

The recent order affects key smartphone companies active in the Indian market. Among them are Apple, a company that has previously clashed with the telecom authority over comparable apps, as well as giants like Samsung, Vivo, Oppo, and Xiaomi.

The Fine Print of the Official Mandate

An order dated 28 November provides phone manufacturers a 90-day window to guarantee that the government's "Messenger Friend" application is factory-loaded on all new devices. A key condition is that owners cannot disable the software.

For phones already in the supply chain, makers are directed to send the app via software patches. It is worth mentioning that this order was privately circulated and was communicated privately to chosen companies.

Privacy Concerns Voiced

However, legal analysts have raised significant apprehensions regarding this decision. A lawyer specialising in tech issues said that India's directive is a cause for concern.

“The government effectively removes user consent as a meaningful choice,” commented Mishi Choudhary, an expert working on internet advocacy issues.

Consumer organisations had also condemned a comparable mandate by Russia in August for a state-backed communication called Max to be included on phones.

The Scale of the Indian Smartphone Landscape

India, one of the world's largest mobile markets, boasts more than 1.2 billion connections. Government data indicate that the Sanchar Saathi app, launched in January, has already helped locating over 700,000 stolen phones, with an estimated 50,000 recovered in October by itself.

The government argues that the software is vital to combat the “serious endangerment” of telecom cybersecurity from duplicate or spoofed IMEI numbers, which are used for illicit activities and network misuse.

Apple's Likely Response

Apple's iOS runs on an approximate 4.5% of the 735 million mobile phones in India, with the vast majority using Android, as per market research. While Apple includes its own first-party apps on its devices, its company guidelines are said to ban the inclusion of any government application before the purchase of a device.

“Apple has traditionally refused such requests from governments,” said Tarun Pathak, a analyst at Counterpoint.

“It’s expected to pursue a middle ground: rather than a forced pre-install, they might discuss and propose an alternative to encourage users towards downloading the application.”

Queries for response from Apple, Google, Samsung, and Xiaomi went unanswered. India’s telecommunications department also did not respond.

The Role of the IMEI and the Application's Purpose

The IMEI, or International Mobile Equipment Identity, is a 14- to 17-digit number unique to each mobile device. It is most commonly used by networks to block cellular access for phones reported as lost.

The Sanchar Saathi application is chiefly intended to help users track and locate missing phones across all telecom networks, using a national registry. It also allows them to detect, and terminate, illegal mobile connections.

Notable Adoption and Results

With over 5 million downloads since its launch, the software has already helped disable over 3.7 million stolen or lost mobile phones. Moreover, over 30 million fraudulent connections have also been disconnected through its use.

The government asserts that the tool aids in preventing cyberthreats and helps in the tracking and blocking of missing phones, thereby helping police in tracing handsets and keeping counterfeits out of the black market.
